The Pros And Cons Of The Legal Ruling On Misyar Marriage And Its Proposed Solutions

Misyar marriage is a contemporary phenomenon in Islamic family law that has generated intense debate among scholars and academics, particularly concerning the tension between the formal validity of the marriage contract and the substantive objectives of marriage. This study aims to analyze the pros and cons of the legal ruling on misyar marriage and to formulate solutions for addressing it from the perspective of Islamic law. The research employs a qualitative method based on library research, using normative, socio-legal, and maqāṣid al-sharī‘ah analytical approaches. The main argument of this study asserts that legal assessment of misyar marriage is inadequate if it relies solely on the fulfillment of the pillars and conditions of marriage; rather, it must be evaluated in light of the objectives of the Sharī‘ah and the principle of preventing harm. The findings indicate that although misyar marriage may be considered formally valid and may offer limited benefits under certain circumstances, in practice it has the potential to generate more dominant harms, particularly with regard to the protection of women and children, uncertainty over financial maintenance responsibilities, and the degradation of the purpose of marriage as a mīthāqan ghalīẓan. Therefore, this study emphasizes that the permissibility of misyar marriage, if considered at all, should be highly restricted and accompanied by strict conditions. The proposed solutions include normative, ethical, and institutional approaches to ensure justice and protection within Islamic family law.
