Sexual violence against children within educational institutions constitutes a serious threat to children’s physical integrity, psychological well-being, dignity, and future development. This study examines the implementation of child protection policies against sexual violence in Indonesian educational institutions through an integrated analysis of positive law and the perspective of Fiqh Siyasah. The study employs a normative juridical method with a descriptive-analytical approach to examine the regulatory framework established under Law No. 12 of 2022 on Sexual Violence Crimes and Law No. 35 of 2014 on Child Protection. The findings indicate that Indonesia has established a relatively comprehensive legal framework for preventing and addressing sexual violence against children. Policy implementation, however, remains constrained by structural challenges, including unequal power relations, patriarchal cultural patterns, institutional vulnerabilities, and stigma surrounding the reporting of sexual violence. The Fiqh Siyasah perspective conceptualizes child protection as a state responsibility and an amanah entrusted to ulil amri. This responsibility is grounded in the principles of Maqashid al-Shariah, particularly hifz al-nafs (protection of life) and hifz al-'irdh (protection of dignity and honor). Effective policy implementation requires stronger institutional coordination, accessible reporting mechanisms, victim-centered services, and integrated restitution and rehabilitation. Harmonizing national legal instruments with Islamic ethical principles can strengthen state accountability and promote the substantive protection and welfare of child victims within educational institutions.
